USCIS aumenta a partir de hoy varias tarifas de trámites migratorios, incluida Green Card y la ciudadanía

Este lunes comienzan a aplicar las nuevas tarifas de la oficina de Servicios de Ciudadanía e Inmigración, las cuales contemplan ajustes en petición de ciudadanía y Green Card, así como visas de trabajo

Apartir de este 1 de abril, la oficina de Servicios de Ciudadanía e Inmigración (USCIS) realiza los ajustes de tarifa para el proceso de naturalización en un cinco por ciento, además del 26% en la petición de Green Card.
Sin embargo, la agencia está revisando su manual de operaciones para determinar en qué casos se harán descuentos significativos.
El nuevo costo del proceso de naturalización es de $760 dólares, es decir $35 dólares más. Esto incluirá el servicio de datos biométricos.
En el caso de una Green Card o petición de Cambio de Estatus tendrá un costo de $1,440 dólares, lo que significa un incremento del 26% o $300 dólares, según el Registro Federal.
Sobre los descuentos en algunos procesos, USCIS especificó que serán para aquellas familias con bajos ingresos, por lo que el proceso de naturalización será de $380 dólares, pero la petición debe incluir la documentación que justifique el costo reducido.
Desde el 2016 la agencia no realizaba ajustes a las tarifas, pero los incrementos no son integrales, ya que USCIS destaca los descuentos para aquellos inmigrantes o familias que logren demostrar bajos ingresos y condiciones de desventaja.
“[Se] está revisando la guía de políticas del Manual de USCIS para alinearse con la lista de tarifas y cambios a ciertos otros beneficios de inmigración”, indicó este lunes la agencia.

Recordó que el cambio de tarifas fue anunciado el 31 de enero del 2024, luego de un proceso iniciado en 2023.
“La Sección 286(m) de la Ley de Inmigración y Nacionalidad (INA) autoriza al Departamento de Seguridad Nacional (DHS) cobrar tarifas por los servicios de adjudicación y naturalización a un nivel que ‘garantizar la recuperación de los costos totales de la prestación de todos esos servicios, incluidos los costos de servicios similares proporcionado sin cargo a los solicitantes de asilo u otros inmigrantes’”, señala la agencia.
USCIS recordó que adjudicará los costos y descuentos a las solicitudes o peticiones con matasellos a la fecha de vigencia del 1 de abril, pero en el caso de naturalización ese beneficio podría alcanzar algunas peticiones que ya están en proceso antes de la fecha indicada.

Un ajuste necesario, pero criticado
En enero, la directora de la agencia, Ur Jaddou, destacó que la actualización del costo tarifario era necesaria para enfrentar los gastos de operación de USCIS, al recordar que es una dependencia que que recibe poco presupuesto federal y opera más del 90 por ciento con los costos de servicios.
“Por primera vez en más de siete años, USCIS está actualizando nuestras tarifas para satisfacer mejor las necesidades de nuestra agencia, permitiéndonos brindar decisiones más oportunas a aquellos a quienes servimos”, dijo Jaddou.
Antes de realizar los ajustes, USCIS recibió 5,400 comentarios sobre la regla, sugerencias que incluyó en el lineamiento final, enfocado a programas humanitarios.

Qué otras tarifas aumentan
Varias visas y servicios registran incrementos. A continuación algunos ejemplos:
– I-102 Aplicación de Reemplazo o Documento de Arribo y Salida, pasó de $445 a $560 dólares, un aumento del 26%.
– La clasificación de visa H-1 pasó de $460 a $780 dólares, un aumento del 70%.
– Petición de visa L para visa de trabajador pasó de $460 a $1,385 dólares, un aumento del 201%
– La visa O (trabajador con habilidades extraordinarias) pasó de $460 a $1,055 dólares, un alza del 129%.
– Documento de viaje (I-131) pasó de $575 a $630 dólares, un alza del 10%.
– La I-130 o Petición de un Familiar aumentó de $535 a $675 dólares, es decir, 26%.
– El documento I-192 o Aplicación de Ingreso en Avanzada para No-Inmigrante (CBP) aumentó de $585 a $1,100 dólares, es decir 88%.
– El I-212 o Aplicación de Permiso para Reaplicar para Admisión a EE.UU. tras la deportación pasó de $930 a $1,175 dólares, un alza del 26%
– I-694 o Notificación de Apelar una Decisión pasó de $890 a $1,125 dólares, un alza del 26%.

“Section 286(m) of the Immigration and Nationality Act (INA) authorizes the Department of Homeland Security (DHS) to charge fees for adjudication and naturalization services at a level that ‘ensures recovery of the full costs of providing of all such services, including the costs of similar services provided free of charge to asylum seekers or other immigrants,’” the agency notes.
USCIS recalled that it will award the costs and discounts to applications or petitions postmarked by the effective date of April 1, but in the case of naturalization that benefit could reach some petitions that are already in process before the indicated date.

A necessary adjustment, but criticized
In January, the director of the agency, Ur Jaddou, highlighted that the update of the tariff cost was necessary to face the operating expenses of USCIS, remembering that it is an agency that receives little federal budget and operates more than 90 percent with service costs.
“For the first time in more than seven years, USCIS is updating our fees to better meet the needs of our agency, allowing us to provide more timely decisions to those we serve,” Jaddou said.
Before making the adjustments, USCIS received 5,400 comments on the rule, suggestions it included in the final guidance, focused on humanitarian programs.

What other rates increase
Several visas and services register increases. Here are some examples:
