Children’s Sexual & Reproductive Rights

Since the passing of AB 329 we’ve been seeing a lot of changes, but one that many people may not be aware of, is that California Education Code § 51934 now states that schools should inform students of their sexual & reproductive rights, as well as inform them of their “local resources” such as planned parenthood and teen centers where they can obtain “sensitive health care services” – contraceptives, STD and HIV testing, abortions, prenatal care, substance abuse, mental health appointments, etc. and who knows what else falls under the Sensitive Healthcare Services category.
A 12 year old minor now has a right to the above-mentioned services, and a girl has a right to an abortion at ANY age.  Schools are required by law to protect their privacy. If students miss class to get services, teachers must allow them to make up missed work with full credit. If you think this sounds exaggerated, read what a DSUSD senior employee said to a mom last week:
Mom: So, if my child comes here and says I’m pregnant, what’s the procedure?
DSUSD employee: I would hand your daughter the phone and the number to one of our local resources and leave her alone so she can make arrangements.
Mom: How would my daughter get to that appointment?
DSUSD employee: That is for her to arrange with the clinic, friends, family, or she could call an Uber to take her to the clinic and come back
Mom: So, you are telling me that the school would allow my 12-year-old daughter to leave school grounds without me knowing, get in a car with a stranger, go get an abortion, and come back just like that?
DSUSD employee: If she didn’t feel good afterwards, I would have her call you from the Nurse’s office to pick her up with a stomach ache or something.

Derechos Sexuales y Reproductivos de los Niños

Desde que se aprobó la AB 329 hemos visto varios cambios, pero uno de los que muchas personas pueden no estar enteradas es que el Código de Educación de California § 51934 ahora declara que las escuelas deben informar a los estudiantes sus derechos sexuales y reproductivos, así como informarles de sus “recursos locales” como planned parenthood y los centros de adolescentes donde pueden obtener “servicios sensibles de cuidado de salud” – anticonceptivos, pruebas de enfermedades venéreas y VIH, abortos, cuidado prenatal, abuso de substancias, citas de salud mental, etc. Y quien sabe que más cae en la categoría de Servicios Sensibles de Cuidado de Salud.
Un niño de 12 años ahora tiene derecho a los servicios arriba mencionados, y una niña tiene derecho a un aborto a CUALQUIER edad. Las escuelas por ley deben proteger la privacidad de los estudiantes. Si un estudiante falta a clase por obtener servicios, los maestros deben permitir que entreguen los trabajos atrasados con crédito completo. Si creen que esto suena exagerado, lean lo que una empleada del Distrito Desert Sands dijo a una mama la semana pasada:
Mama: Entonces, si mi hija viene y dice estoy embarazada, ¿cuál es el procedimiento?
Empleada DSUSD: Le daría el teléfono a su hija y el número de uno de nuestros recursos locales y la dejaría sola para que hiciera arreglos.
Mama: ¿Como llegaría mi hija a esa cita?
Empleada DSUSD: Eso lo arreglaría ella con la clínica, amigos, familiar, o podría tomar un Uber a la clínica y regresar.
Mama: Entonces, me estás diciendo que la escuela permitiría a mi hija de 12 años irse de la escuela sin notificarme, subirse a un carro con un extraño, ¿obtener un aborto y regresar ¿así nadamas?
Empleada DSUSD: Si ella no se sintiera bien al Volver, la haría que le llamara de la enfermería para que la recogiera con un dolor de estómago o algo.
