La Forma más Exitosa para obtener una Green Card

Un nuevo límite máximo imponible y el ajuste del Costo de Vida son algunos de los cambios que se efectuarán para el próximo año

Aunque miles de casos tardan incluso más de 20 años en tener una respuesta, la forma más exitosa de obtener una Green Card sigue siendo a través de petición familiar, según un reporte del Congreso de Estados Unidos.

El informe fue publicado en octubre de este año, pero toma relevancia en medio de las negociaciones de congresistas por ajustes en inmigración, pero destaca que el 58% de las personas que han logrado la Residencia Legal, ya sea permanente o condicionada, ha sido a través de peticiones familiares.

Según la Ley de Nacionalidad e Inmigración (INA, en inglés), además del matrimonio, otras formas por petición familiar es cuando padres patrocinan a hijos o viceversa, además de hermanos, para otorgar la Residencia Legal Permanente (LPR, en inglés).

“El mayor número de LPR son admitidos a través de categorías patrocinadas por la familia, seguidas de las basadas en el empleo”, confirma el reporte. “Los límites legales limitan el número anual de personas a quien se les puede otorgar el estatus de LPR a través del programa patrocinado por la familia”.

El 27% de las LPR fueron personas basadas en el empleo, el 8% a través de programas de asilo y refugio, el 4% a través de las visas de la diversidad y un 3% por otra vía, según el reporte que retoma datos de la oficina de Servicios de Ciudadanía e Inmigración (USCIS).

El reporte agrega que 12.9 millones de inmigrantes con Green Card vivían en 2022 en EE.UU., cifra que este año pudo aumentar al menos en un millón, ya quel mismo informe señala que cada año se otorga esa cifra adicional de LPR.

Cabe destacar que la cifra debería también tener un ajuste, considerando aquellos que aplican por la naturalización y cambian de categoría. En 2022 se estimada que 9.2 millones de personas ya podían aplicar por la ciudadanía.

Las admisiones para obtener una Green Card habían bajado en 2020 y 2021, quizás por la pandemia de COVID-19, indica el reporte, pero hubo un incremento en 2022 con poco más de un millón de admisiones.

“El 46% fueron recién llegados a los Estados Unidos y el 54% se ajustaron al estatus LPR desde un estatus de no inmigrante dentro de los Estados Unidos”, expone el reporte.

Es decir, una ligera mayoría cambió su estatus migratorio en EE.UU. tras cubrir los requisitos, incluidas las revisiones de seguridad nacional.

En 2022, de las peticiones, 480,000 fueron por patrocinio familiar, mientras 140,000 por el sistema basado en el empleo y 55,000 por la llamada “lotería de visas”, como se le conoce al Programa de Visas de la Diversidad (DV).
