La oficina de Servicios de Ciudadanía e Inmigración busca evitar abusos y mejorar las condiciones migratorias de ciertos inmigrantes con permisos laborales, a quienes podría dar posibilidad de obtener una Green Card

Todavía es un plan, pero la oficina de Servicios de Ciudadanía e Inmigración (USCIS) prepara una regla para permitir a ciertos trabajadores con permisos temporales aplicar por una Green Card.
Esto formaría parte del plan del Departamento de Seguridad Nacional (DHS) para “modernizar y reformar” las visas H-2A y H-2B, que se utilizan para trabajadores agrícolas y de servicios.
La regla para obtener la Green Card incorporaría políticas para abordar la “explotación y el abuso”, proteger a los trabajadores y aumentar la eficiencia del programa, según un reporte de Fox News.
El plan sigue en elaboración y todo indica que sería una regla que pasaría por el proceso administrativo adecuado, es decir, recibiría comentarios públicos en el Registro Federal.
USCIS agregaría una “doble intención” a las visas H-2A y H-2B, que actualmente indican explícitamente que los trabajadores deben regresar a su país después de completar su período de trabajo marcado en el permiso correspondiente.
Otras visas laborales abren la posibilidad de obtener una Green Card, es conocida como “doble intención” es decir, que pueden laborar y, eventualmente, solicitar la residencia bajo ciertas condiciones.
El plan busca resolver el problema de abusos laborales y los cobros indebidos por el trámite de una Green Card.
“La regla también fortalecería las prohibiciones de que sus empleados cobren tarifas de inmigración a los trabajadores H-2 a través de reducciones salariales, e introduciría factores por los cuales una petición podría ser denegada en base a medidas disciplinarias tomadas contra un empleador por una agencia gubernamental como USCIS o el Departamento de Trabajo”, dice el reporte.
Incluso las autoridades migratorias permitirían a esos beneficiarios continuar trabajando, una vez que hicieron la petición de Green Card.
Por ahora, todo es un plan y habrá que ver cuándo se implementa, pero reglas de este tipo tardan en avanzar, al menos seis meses, debido a que deben recibir comentarios públicos, ser integrados por autoridades y redactar una regla final.

Even the immigration authorities would allow those beneficiaries to continue working, once they made the request for a Green Card.
For now, everything is a plan and it will be necessary to see when it is implemented, but rules of this type take time to advance, at least six months, because they must receive public comments, be integrated by authorities and draft a final rule.
