Se violan los derechos de la primera Enmienda

El pastor Tim Thompson de Murrieta, un ex marine y capellán de los Estados Unidos al Departamento del Sheriff del Condado de Riverside, fue arrestado a última hora de la tarde del viernes, el 1 de mayo de2020 en las escalinatas del Capitolio de California. No fue el único arrestado y citado, los líderes de Freedom Angels, un grupo de madres que abogaban por la infancia y la libertad constitucional también fueron señalados al igual que el pastor Tim, arrancado del frente de la línea, y puesto esposado por ejercer sus derechos constitucionalmente protegidos. Más de 30 personas de diferentes rangos de edad y orígenes étnicos y socioeconómicos fueron detenidas en total. Fueron acusados de “Poner en peligro la salud pública”” incluso cuando algunos de los oficiales de la CHP que detienen no llevaban cubiertas faciales en el momento de la detención.
La Primera Enmienda de la Constitución de los Estados Unidos establece: “El Congreso no hará ninguna ley con respecto al establecimiento de religión, o prohíba el libre ejercicio de la misma; o limitando la libertad de expresión, o de la prensa; o el derecho del pueblo a reunirse pacíficamente, y a solicitar al Gobierno una reparación de los agravios. “Eso es exactamente lo que estaban haciendo, no sólo en el Capitolio del Estado, sino en todo el estado en diferentes lugares la gente estaba ejerciendo sus creencias religiosas, la libertad de expresión, pacíficamente para reunirse y pedir al Gobierno para una reparación de agravios, al igual que la Constitución afirma.
“La música estaba tocando, la gente estaba bailando, había círculos de oración, la gente ondeaba sus banderas e incluso los oficiales de policía que estaban allí, estábamos interactuando con ellos, le dijimos lo agradecidos que estábamos de que estuvieran allí. Hemos detectado un problema desconocido. De repente varios cientos de agentes de policía salieron con equipo antidisturbios y fui simplemente a ver lo que estaba pasando, porque no sabía lo que estaban haciendo o por qué lo hacían y encendí mi teléfono y de repente uno de los oficiales me señaló y me reconoció, no sé si me estaban buscando porque yo era uno de los oradores y lo que le estaba diciendo a la gente era ‘abrir sus iglesias’, que es un acto de desobediencia civil en este momento. Me vieron, me agarraron y me arrestaron”, dijo el pastor Thompson en un video publicado en churchunited.com
Bob Waugh, de 60 años, un oficial de la ley retirado de Lodi (Condado de San Joaquín), dijo al San Francisco Chronicle que la respuesta de California a la crisis no siguió ninguna lógica. Mientras la gente está atascada en casa del trabajo, dijo, Newsom llamó la semana pasada a un cuerpo de voluntarios para ayudar a organizaciones sin fines de lucro que están sirviendo a una oleada de californianos necesitados. Waugh dijo que el gobierno estaba usando la situación para ejercer más control sobre los derechos de las personas. “Es una postura política”, dijo. “Cerrar un país por tanto tiempo, no hay justificación para esto”.
Si las protestas del 1 de mayo fueran pacíficas y ordenadas, ¿por qué ordenaría al CHP que se transformara en equipo antidisturbios y no sólo detuviera a los ciudadanos que ejercían sus derechos de la Primera Enmienda? No ha hecho una declaración oficial abordando esta situación en particular, apenas ‘sugirió’ durante una de sus sesiones informativas que ‘no había ordenado’ el ataque contra el pueblo. Sí, ¿y debemos creer le que tampoco ordenó a los francotiradores en el techo? ¿Qué tenía la intención de suceder en el Capitolio ese día?

 

Pastor Tim Thompson from Murrieta, a former United States Marine and Chaplain to the Riverside County Sheriff’s Department, was arrested late Friday afternoon, May 1, 2020 on the steps of California’s Capitol. He was not the only one arrested and cited, the leaders of Freedom Angels, a group of moms who advocate for children and constitutional freedom were also singled out just as Pastor Tim, ripped from the front of the line, and placed in handcuffs for exercising their constitutionally protected rights. Over 30 people from different age range and ethnic and socioeconomic backgrounds were arrested altogether. They were charged with “Endangering Public Health” even when some of the arresting CHP officers were not wearing face coverings either at the time of the arrest.
The First Amendment of the United States Constitution states, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” That is exactly what they were doing, not only at the State Capitol, but all throughout the state at different locations people were exercising their religious beliefs, free speech, peaceably to assembling and, petitioning the Government for a redress of grievances, just as the Constitution states.
“Music was playing, people were dancing, there were prayer circles, people were waving their flags and even the police officers that were there, we were interacting with them, we told them how grateful we were that they were there. They were very responsive, but something changed towards the end. All of a sudden several hundreds police officers came out in riot gear and I went over simply to see what was going on, because I didn’t know what they were doing or why they were doing it and I turned my phone on and all of a sudden one of the officers pointed at me and recognized me, I don’t know if they were looking for me because I was one of the speakers and what I was telling the people was ‘open your churches,’ which is an act of civil disobedience at this point. They saw me, they grabbed me and took me into custody,” Pastor Thompson said in a video posted on churchunited.com
Bob Waugh, 60, a retired law enforcement officer from Lodi (San Joaquin County), told the San Francisco Chronicle that California’s response to the crisis followed no logic. While people are stuck home from work, he said, Newsom called last week for a corps of volunteers to help nonprofits that are serving a surge of needy Californians. Waugh said the government was using the situation to exert more control over people’s rights. “It’s political posturing,” he said. “Closing down a country for this long, there’s no justification for this.”
If the May 1 protests were peaceful and orderly, why would he order the CHP to change into riot gear and not only rough up but arrest the citizens who were exercising their First Amendment rights? He hasn’t made an official statement addressing this particular situation, he barely ‘suggested’ during one of his briefings that ‘he hadn’t ordered’ the attack against the people. Yeah right, and we are to believe him that he didn’t order the snipers on the roof either? What did Gavin Newsom really intend to happen at the Capitol that day?
