La administración del presidente Joe Biden tendrá tiempo para apelar el fallo de un juez de California que ordenó bloquear medida de asilo
Un juez federal bloqueó una medida de la administración del presidente Joe Biden que permite al Departamento de Seguridad Nacional (DHS) negar asilo a los migrantes que buscan cruzar desde México a Estados Unidos sin primero presentar su solicitud a través de medios digitales como CBP One y buscar antes protección de un tercer país por el que realizaron su recorrido.
Sin embargo, este fallo del juez de distrito de Estados Unidos, Jon Tigar, perteneciente al Distrito Norte de California, no entrará en vigor de manera inmediata debido a que se le dio tiempo a la administración de Biden para poder apelar el fallo.
De acuerdo con la normativa adoptada por la Casa Blanca, tras la entrada en vigor del Título 8, se impone a los solicitantes de asilo espacio para excepciones y no se aplica a los niños que realizan su viaje solos.
La medida de poner restricciones a los solicitantes de asilo ha causado polémica entre las organizaciones civiles debido a que argumentan que se obliga a los migrantes a solicitar antes la acogida de un tercer país, considerado como seguro, pero que no cuentan con las protecciones de derechos humanos que ofrece Estados Unidos.
Además, dentro de las quejas está en que la aplicación CBP One, donde los migrantes tienen que registrarse para poder solicitar asilo, no cuenta con suficientes citas ni idiomas, situación que hace complejo el trámite y se convierte en un obstáculo que deja a los migrantes en un limbo peligroso.

The measure to place restrictions on asylum seekers has caused controversy among civil organizations because they argue that migrants are forced to first request reception in a third country, considered safe, but that they do not have the human rights protections offered by the United States.
In addition, among the complaints is that the CBP One application, where migrants have to register to be able to request asylum, does not have enough appointments or languages, a situation that makes the process complex and becomes an obstacle that leaves migrants in a dangerous limbo.
